1.1 “Leuchtbuchstaben Austria – LB Projektmanagement KG” is the company and owner of the products.<\/span><\/p>\n

1.2 The “Lessee” refers to the person, company, organization or firm that rents the Products.<\/span><\/p>\n

1.3 “Terms” means these Rental Terms.<\/span><\/p>\n

1.4 The “Products” means all products and accessories for the Lessee.<\/span><\/p>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

2. General terms and conditions for events\n<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t

2.1 These General Terms and Conditions apply to the exclusion of all other terms and conditions proposed by the Lessee, unless Leuchtbuchstaben Austria and the Lessee have agreed otherwise in writing.<\/span><\/p>\n

2.2 Leuchtbuchstaben Austria undertakes to rent equipment to the Lessee under the terms and conditions set forth in this document. If the renter wants to rent products, the renter must sign the offer, fill out the booking form and complete all other documents required for Leuchtbuchstaben Austria.<\/span><\/p>\n

2.3 Leuchtbuchstaben Austria may, at its own discretion, refuse to rent products to the lessee at any time if there is a valid reason for doing so.<\/span><\/p>\n

2.4 The offer or invoice must be signed before the event date, hereby the renter agrees to comply with these terms and conditions.<\/span><\/p>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

3. Rental periods\n<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t

3.1 Rental prices are calculated on the basis of the days of use (day of the event for approx.24h). Pick-up on the day before or return on the day after the event (subject to availability) do NOT count as days of use and will not be charged additionally. An extension of the rental period may be requested by the renter subject to the availability of the products. Leuchtbuchstaben Austria will provide a quote based on the desired rental period. <\/span><\/p>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

4. Delivery, assembly and collection\n<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t

4.1 Leuchtbuchstaben Austria offers a full transport service. Transportation costs will be calculated based on the specific venue\/times of the event\/products and confirmed at the time of booking confirmation.<\/span><\/p>\n

4.2 It is necessary that the Lessee contacts the venue to obtain permission for the installation of Leuchtbuchstaben Austria’s products on its premises and that sufficient space and electricity are provided or informed that batteries and charging cables will be provided by Leuchtbuchstaben Austria prior to delivery.<\/span><\/p>\n

4.3 During the delivery, set-up and pick-up times for illuminated letters Austria, a contact person must be available on site at all times to show the contact person how to use the rented products and to sign the delivery bill. The lessee must inform Leuchtbuchstaben Austria about the contact details of the contact person (phone number and name)at least 24h before the delivery.<\/span><\/p>\n

4.4 The lessee must notify Leuchtbuchstaben Austria of any required permits, instructions or additional documents no later than 7 days before the delivery date. Otherwise, an additional administrative fee of 50 euros, plus additional the cost of the permit that will be charged to the tenant. <\/span><\/p>\n

4.5 The renter is responsible for allowing Leuchtbuchstaben Austria sufficient time and access to the venue for set-up and pick-up.<\/span><\/p>\n

4.6 Delivery and collection outside our standard hours (Monday – Sunday 8:00 – 20:00) will be charged an additional surcharge of 50% of the transport price.<\/span><\/p>\n

4.7 In the event that Leuchtbuchstaben Austria is issued a fine due to an incorrect instruction by the lessee (permission not obtained, etc.), the lessee will be invoiced for the fine with the specified due date.<\/span><\/p>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

5. Deposit & payment<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t

5.1 A deposit of 20% of the total rental fee (including transportation costs) is required at the time of booking to secure the products for the rental date. The initial booking fee of 20% will be refunded in case of cancellation, change of mind or change of date up to 30 days before the booking date.<\/span><\/p>\n

5.2 If the availability of the products allows it, a product can be added to a booking subsequently. However, please note that this may affect the transportation fee.<\/span><\/p>\n

5.3 All payments must be made by the dates specified on the invoice. In case of non-payment by these dates, the reservation will be cancelled.<\/span><\/p>\n

5.4 The remaining amount is to be paid by the renter before the assembly, if the transport has been booked or during the self-collection.<\/span><\/p>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

6. Loss, damage and other charges<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t
\n\t\t\t\t\t\t\t

All items are used and therefore show reasonable signs of use, as they are permanent rental items.<\/span><\/p>\n

6.1 I, as the renter, assume full responsibility for the condition of all products during the rental period or until they are returned to Leuchtbuchstaben Austria and am liable for any damage incurred or loss of the products. Any equipment lost, damaged or stolen during the rental must be paid for by the renter. The lessee shall pay Leuchtbuchstaben Austria the actual cost of replacing or, at Leuchtbuchstaben Austria’s discretion, repairing the products, regardless of the age or condition of the products, at the current replacement cost.<\/span><\/p>\n

6.2 In the event of a dispute, Leuchtbuchstaben Austria will take photos of the products as soon as they are set up and showing the current condition of the equipment at the beginning of the rental period. Lessee shall be liable for any negligent act, omission or breach of these Terms and Conditions throughout the term of the rental.<\/span><\/p>\n

6.3 The Lessee undertakes to remove all items attached to products by the agreed collection time. If you do not remove items, you will be charged a removal fee, which is listed below.<\/span><\/p>\n

6.4 A cleaning fee will be charged for dirty returns or wet letters. No “colored smoke bombs\/fountains” should be placed in the immediate vicinity of the products, as this may result in heavy, non-removable soiling or damage to the letters. <\/span><\/p>\n

6.5 Failure to return the Dry Hire Products by the agreed date will result in an extension of the hire at the standard product price. If the products are not returned within 48h after the agreed date, Leuchtbuchstaben Austria will consider the products stolen and charge the renter for the replacement costs.<\/span><\/p>\n

6.6 The lessee undertakes to grant Leuchtbuchstaben Austria access to the venue or event location in order to deliver or collect the rented products at the agreed times. Delivery and pick-up times will be communicated to the renter in writing before the start of the rental period. If the rental period exceeds the specified times, Leuchtbuchstaben Austria reserves the right to charge the renter a fee for re-transportation and an extended rental fee.<\/span><\/p>\n

6.7 Details of any gross damage\/loss\/charges that may occur:<\/span><\/p>\n

    \n
  • Base plate 10\u20ac <\/span><\/li>\n
  • Battery 25\u20ac<\/span><\/li>\n
  • Lamp – 10\u20ac<\/span><\/li>\n
  • Remote control – 20\u20ac<\/span><\/li>\n
  • Repair (working time 30\u20ac-50\u20ac per letter)<\/span><\/li>\n
  • Damage directly to aluminum \/ neon products (dents \/ cable torn out, etc.) – From 150 \u20ac – replacement value if completely damaged\n

    <\/span><\/li>\n<\/ul>\n

    – Removal of objects attached to the equipment – 20\u20ac (balloons,flowers,garlands,bows etc.)<\/span><\/p>\n

    – Cleaning fee for heavy soiling – 15\u20ac per letter <\/span><\/p>\n

    6.8 In the event of damage, loss of products or other charges incurred, the Lessee will receive an invoice for the cost of repair, replacement or labor. Payment is required within 7 days of notification.<\/span><\/p>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    7. Weather<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t\t\t

    7.1 The products of Leuchtbuchstaben Austria are mainly designed for indoor use, although they can be used outdoors in good conditions. Due to the nature of the products, significant damage may occur if the products are exposed to wet weather conditions. If outdoor installation is planned but weather conditions are not suitable for the products (e.g. impending wet weather, rain or high winds, etc.), an alternative location for installation must be agreed.<\/span><\/p>\n

    7.2 The staff of Leuchtbuchstaben Austria will take precautions and cooperate with the venues or the contact person to limit the risk of weather damage to the products during setup. However, Leuchtbuchstaben Austria reserves the right to move the products from any previously agreed location in case of impending weather that could damage the products. If a suitable location cannot be found to set up the products out of the weather, Leuchtbuchstaben Austria reserves the right to refuse the set up and all monies paid will be forfeited.<\/span><\/p>\n

    7.3 Throughout the rental period, the Renter is liable for any damage caused to the equipment and is therefore responsible for taking the products out of the weather to avoid damage. Illuminated letters Austria products must not be left outdoors overnight under any circumstances.<\/span><\/p>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    8.Cancellation<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t\t\t

    8.1 Cancellations must be received by Leuchtbuchstaben Austria in writing at office@leuchtbuchstaben-mieten.at. Leuchtbuchstaben Austria reserves the right to charge the customer according to the schedule below to compensate Leuchtbuchstaben Austria for any costs, expenses, or losses incurred in the event of cancellation by the renter.<\/span><\/p>\n

    Refunds will be granted as follows;<\/span><\/p>\n

    Cancellation up to 30 days prior to the rental date – All monies will be refunded 100%.<\/span><\/p>\n

    8.2 There is no refund for products that are canceled upon delivery.<\/span><\/p>\n

    8.3 No refund will be made for cancellations of custom orders.<\/span><\/p>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    9. COVID 19\/ Exceptions<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t\t\t

    Given the current global pandemic and the impact it is currently having on the events industry, Leuchtbuchstaben Austria is committed to working with the tenant when the unexpected occurs. The following applies to government-imposed restrictions that directly affect the conduct of your event. Leuchtbuchstaben Austria will check your booking according to the following terms and conditions.<\/span><\/p>\n

    9.1 All requests for schedule changes\/postponements must be sent in writing to office@leuchtbuchstaben-mieten.at and reviewed on a case-by-case basis.<\/span><\/p>\n

    9.2 If an event cannot be held due to a government imposed restriction, all monies paid will be retained as a credit for a period of 12 months from the original rental date.<\/span><\/p>\n

    9.3 This date change does not allow for product changes due to venue or opinion changes, however, deliveries may change due to venue or location changes at the discretion of Leuchtbuchstaben Austria.<\/span><\/p>\n

    9.4 If your event does not take place within 12 months of the original rental date, all monies paid will be forfeited and are non-transferable.<\/span><\/p>\n

    9.5 In case of cancellation of postponed events, full payment will be due.<\/span><\/p>\n

    9.6 Once a new event date has been confirmed, Leuchtbuchstaben Austria will reschedule your booking to your new date, subject to availability. If products are not available on the new event date, Leuchtbuchstaben Austria will help the tenant find an alternative option. If no suitable alternative is available, these funds are forfeited to the tenant.<\/span><\/p>\n

    9.7 The above terms and conditions apply only to a single date change, unless there is another restriction imposed by the Government. <\/span><\/p>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    10. Insurance<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t
    \n\t\t\t\t\t\t\t

    10.1 Leuchtbuchstaben Austria recommends that separate “event” insurance be considered to cover contingencies such as theft and other unforeseen events such as severe damage, etc.<\/span><\/p>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    11. Copyright<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    11.1 Leuchtbuchstaben Austria is the owner of all intellectual property, including all designs, literary and artistic works, documentation, plans, drawings, specifications, sketches, reports, graphics and logos created by Leuchtbuchstaben Austria.<\/span><\/p>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    12.Disputes<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t
    \n\t\t\t\t\t\t\t

    12.1 Any disputes must be made in writing within 24 hours of the end of the rental period in order for Leuchtbuchstaben Austria to consider refunds. If disputes are not formally submitted within this period, no action can be taken against Leuchtbuchstaben Austria.<\/span><\/p>\n

    12.2 If problems occur during the rental period and the lessee does not make any attempt to contact Leuchtbuchstaben Austria in writing by mail and also by phone to resolve the problem, no compensation can be made afterwards.<\/span><\/p>\n

    12.3 Leuchtbuchstaben Austria has the right to change the General Terms and Conditions, but the renter will be informed about the change.
